How does the Spanish LAU 5-year tenant protection work compared to UK AST?

The Spanish Ley de Arrendamientos Urbanos (LAU), updated by the 2023 Housing Act, gives residential tenants one of the strongest protection regimes in Europe — radically different from the UK AST (Assured Shorthold Tenancy) you may be familiar with.

YOUR CONTRACT, STEP BY STEP

Mandatory renewal: 5 years (individual) or 7 years (company)

The initial contract is usually signed for 12 months, but the extension is a unilateral tenant right:

  • If your landlord is an individual, you can extend annually for up to 5 years from signing.
  • If the landlord is a company, that protection extends to 7 years.
  • Compare with the standard UK AST 6-12 month fixed term: Spanish tenants enjoy long-term stability the UK rental market simply does not offer.

30-day notice to leave after 6 months

After 6 months of occupancy you can give 30 days written notice to leave — you are not locked in to the full term.

  • The contract may include a small proportional indemnity for early termination.
  • After the mandatory 5 or 7 years, tacit annual extensions for up to 3 more years apply.
  • To stop them, either party gives notice: 4 months (landlord) or 2 months (tenant).

If the landlord sells during your tenancy

If the landlord sells the property mid-tenancy, your rights are protected:

  • The new owner inherits the landlord position and must honour your contract through to the end, including extensions.
  • You have right of first refusal (tanteo, to buy at the same price) and right of retraction (retracto, to reclaim a sale to a third party at a better price you were not offered).
  • The landlord must give 30 days notice of the sale.

Do you need a NIE, padrón and Spanish bank account before renting?

In practice, yes — most landlords and agencies require a valid NIE before signing because it is needed for contract registration, tax declarations and utility transfers.

This creates a chicken-and-egg with padrón empadronamiento (town hall registration) which often needs proof of address from a rental contract.

NIE pre-rental: 3 workaround tactics

We coordinate the NIE sequence bilingually so you do not lose viewing time during scouting trips. Three routes work:

  • Apply at the Spanish consulate in your home country before relocating (typical processing 2-6 weeks).
  • Use a Spanish solicitor (abogado) or gestor with power of attorney to obtain it on your behalf in Spain.
  • Landlord-tolerant route: passport + first months upfront while the NIE is in progress, then update the contract.

Padrón empadronamiento via the rental contract

Padrón empadronamiento is your town hall registration at the local Ayuntamiento using your address.

  • Required for Digital Nomad Visa, Non-Lucrative Visa, residency applications, NHS-equivalent healthcare card and school enrolment.
  • The simplest route is a registered long-term rental contract (minimum 11 months for residential LAU).

Digital Nomad Visa, Non-Lucrative Visa and post-Brexit residency

The apartment rental supports your visa application as accommodation evidence:

  • Digital Nomad Visa (Royal Decree 11/2022): a registered long-term LAU rental for at least 12 months plus the padrón certificate is the accepted format.
  • The Non-Lucrative Visa has equivalent accommodation requirements.
  • UK nationals post-Brexit need a separate visa (DNV, Non-Lucrative or long-term residence) for stays beyond the 90/180-day Schengen rule.

How does the 2023 Housing Act and IRAV index affect your rent?

The 2023 Spanish Housing Act (Ley 12/2023) introduced the IRAV index as the annual rent update mechanism with a 3% cap, the option for autonomous communities to declare tensioned-rental areas, and the prohibition of passing IBI and community fees to the tenant in new residential contracts.

IRAV: 3% annual cap on rent increases

Annual rent updates on contracts signed since the Act came into force are governed by the IRAV (Rental Reference Index published by the INE).

  • Maximum cap of 3% per year under the new Act.
  • On older contracts indexed to the Consumer Price Index, exceptional caps of 2% and 3% have applied in recent years.
  • The increase only applies if the contract explicitly allows it, and requires written landlord notice with date and percentage.

Tensioned-rental areas in Andalucía: current as of May 2026

The Act allows autonomous communities to declare tensioned-rental areas, which trigger additional rent caps and limits on new contracts.

  • As of May 2026, Andalucía has NOT declared tensioned-rental areas in Málaga city or on the Costa del Sol.

DEPOSIT AND GUARANTEES

How much is the fianza deposit and what guarantees can the landlord require?

The fianza is your statutory deposit, the Spanish equivalent of UK DPS/TDS/MyDeposits. Spanish law distinguishes the mandatory fianza from additional guarantees: knowing the difference avoids accepting unreasonable landlord demands.

  • Fianza: one month registered with Junta de Andalucía

    One month of rent as statutory deposit, paid at contract signing.

    • The landlord must deposit it with the Agencia de la Vivienda y Rehabilitación de Andalucía (AVRA) within 30 days.
    • This protects your money — it does not stay in landlord hands.
    • Fully refundable at end of tenancy if no damages or unpaid rent.
  • Additional guarantees: up to 2 months extra

    The landlord can request up to two months of additional guarantees, in one of these forms:

    • Aval bancario (traditional bank guarantee).
    • Aval privado from a Spanish insurance provider (ARAG, Endorsa, Mutua de Conflictos).
    • Extra cash deposit.
    • These are also refundable subject to no breach. We help you choose the least costly option and present alternatives to the landlord.
  • Rental income insurance: the landlord pays, not you

    Landlord rental income insurance (covering 6-12 months of unpaid rent) is purchased by the landlord, not the tenant.

    • Sometimes its cost is partially reflected in the asking rent, but the policy belongs to the landlord.
    • If an agency asks you to take out the rent insurance yourself, that is an improper practice we flag immediately.

Can you rent in Spain without a Spanish guarantor (aval) or with a pet?

Yes. There are validated alternative routes for expat tenants without a Spanish bank guarantor and for profiles with pets or non-standard income. We guide you to the option that best fits your situation.

4 alternative routes to the traditional bank guarantor

There are four validated routes when you cannot or prefer not to provide a Spanish bank guarantor:

  • Aval privado from a Spanish insurance provider (ARAG, Endorsa, Mutua de Conflictos): the insurer acts as your aval for an annual tenant fee.
  • Landlord rental income insurance covering 6-12 months of unpaid rent (paid by landlord, sometimes reflected in rent).
  • Extra cash deposit of 1-2 months.
  • Strong solvency profile: permanent employment income above 3x rent and 3 months savings in a Spanish bank account.

Pets on the Costa del Sol: contract clause + negotiation

Spanish civil law does not prohibit pets in residential rentals, but the contract can expressly exclude them.

  • If the contract is silent, pets are allowed.
  • On the Costa del Sol many landlords accept small dogs and cats — the expat community is largely pet-friendly.
